The pressure group trying to open up the pathway past Jeremy Clarkson's Langness home, claims a Law Lords ruling gives people the right to use it.
The short stretch of land, running between the sea and the lighthouse cottages, has been fenced off since the TV presenter complained that people were staring into his kitchen window.
Now the pressure group PROWL says the ruling shows that the owner of the land should have communicated to those using the path that he did not want it dedicated as a public highway.
They say sworn affidavits show that no such intention has been shown by any owner over the contested 21 year period.
The are again demanding the path be re-opened.
