DHSC has prepared practical implementation of Capacity Act 2023
Island residents are fast running out of time to have their say on a new Code of Practice which has been drafted by the Department of Health and Social Care to support the implementation of the Capacity Act 2023, which comes into force in April next year.
The Act establishes a legal framework to support and protect people who may lack capacity to make some decisions for themselves at a particular time.
It aims to ensure that decisions are lawful, proportionate, made in that person's best interests and represent the least restrictive option available, while placing the individual's rights and feelings at the centre of decision-making.
Meanwhile, the code seeks to assist people supporting those who may lack the capacity to make decisions for themselves.
A consultation on the code is currently open.

The draft Code of Practice was laid before the July 2026 sitting of Tynwald.
A public consultation on the Code of Practice is currently open, providing an opportunity for interested parties to review the guidance and inform the final version before relevant provisions of the Act are brought into effect.
