Information Commissioner supports FoI fees in principle, but warns proposals could 'erode the spirit of the law'

Office publishes response to government consultation

The office responsible for regulating the Island's Freedom of Information Act says it's supportive of introducing a fee for submitting FoI requests in principle.

However, the information commissioner warns government's recent consultation into the proposals could erode the spirit of the law by putting up perceived barriers.

Government recently held a public consultation seeking feedback on the possibility of introducing fees and limits to manage the growing number of complex requests submitted to public bodies.

In its response to the consultation, the ICO stresses that any fees must be proportionate to the true cost of handling FoI requests.

While the office says it does support a fee in principle, it warns that using the fee to disincentivise some individuals from making repeat requests may have the unintended consequence of preventing others from exercising their rights.
